COMPLETE TEXT OF PROPOSITION C
Section 1. Purpose.
The purpose of this ordinance is to protect the health, safety, and welfare
of the citizens of Clinton by adopting a set of Building Safety Codes.
Section 2. Building
Safety Standards. The latest addition of the International
Building Code is hereby adopted with the following amendments:
- Insert “City
of Clinton” and “Iowa” where such insertions are necessary and
appropriate.
- Amend Section
101.2 by adding the following sentence “All references to building lines
and zoning are void and the subject matter of Chapter 165, Zoning
Regulations unless such matters are required under the Fire Prevention
Code.”
- Delete Section
101.2.1, Appendices, and insert in lieu thereof the following:
101.2.1 Appendices. Appendix H, Signs, is hereby adopted. All other
Appendices are adopted for reference only.
- Delete Section
101.4, Referenced Code, and insert in lieu thereof the following:
101.4 Referenced Codes. Only those codes adopted separately by the City
of Clinton shall be considered part of the requirements of this code.
- Amend Section
102.4 by adding the following sentence: “Only those codes adopted by the
City of Clinton shall be considered part of the requirements of this
code.”
- Amend Section
102 by adding the following sections:
102.7 Preexisting Installations. Existing installations and equipment
which do not conform to codes adopted by the City of Clinton, but which
were lawfully installed prior to the adoption date of this ordinance may
continue to be used if they are maintained in a safe and satisfactory
manner.
102.8 Historic Buildings. Repairs, alterations, and additions necessary
for the preservation, restoration, rehabilitation, or continued use of a
building, structure, or its service equipment may be made without
conformances to all the requirements of the various adopted codes if
reviewed by the Clinton Historic Preservation Commission and approved by
the Building Official.
102.9 Owners of single family units and apartment buildings with less
than four dwelling units can do their own work as long as it meets the
requirements of this code. This does not apply to buildings with
commercial/industrial uses.

103, Department of Building Safety, in its entirety.
- Amend Section
105.1.1, Annual Permits, by adding the following sentence:
”Permits shall expire in 12 months unless a time schedule is submitted and
approved.”
- Delete Section
105.2(2), in insert in lieu thereof the following under “Buildings”:

105.2(3) and insert I lieu thereof the following under “Buildings”:

105.2 by adding a new subsection under “Buildings”:

105 by adding a new section:
105.8 Contractor Registration. Contractors working in the City of
Clinton are not required to have a “contractor’s license.” All
contractors must be registered with the City and be fully insured.
- Delete Section
109.3.3, Lowest Floor Elevation Inspection, in its entirety.
- Delete Section
109.3.7, Energy-Efficiency Inspection, in its entirety.
- Delete Section
112, Board of Appeals, and insert in lieu thereof the following:
112. Board
of Appeals. All appeals of orders, decisions, or determinations relative to
the application and interpretation of this code shall be made to the
Fire/Housing Board of Appeals. Membership of the Fire/Housing Board of
Appeals shall be expanded to include the following:
Electrical Contractor
Plumbing Contractor
Heating/Air Conditioning Contractor
Building Official (ex-officio)
Fire Marshall (ex-officio)

Amend Section 3201.1 by adding “All
public right-of-way encroachments, except those listed in this section, must
have the approval of the City Council. Handicapped ramps, overhanging
signs, awnings, and steps needed to access a property may be installed with
the approval of the Public Works Department.”
Section 3.
Residential Building Safety Standards. The latest edition of the
International Residential Code is hereby adopted with the following
amendments.
1. Insert “City of
Clinton” and “Iowa” where such insertions are necessary and
appropriate.
2. Amend
Chapter 1 by adding the following sentence after the title:
“Where a conflict exists between the International Residential Code and the
International Building Code in the administration this code, the
requirements of Chapter 1 of the International Building Code shall
apply.”
3. Amend
Section R101.2 by adding the following sentence “All references to building
lines and zoning are void and the subject matter of Chapter 165, Zoning
Regulations unless such matters are required under the Fire Prevention
Code.”
4. Delete
Section R102.5, Appendices by adding the following sentence: “Appendix E,
Manufactured Housing Used as Dwelling is hereby made part of the code.

One-story wood frame buildings used as private
garages, accessory to a single-family dwelling and not over 1,000 square
feet in floor area may be constructed on a floating slab-on-grade provided
the following conditions are met: A concrete perimeter grade-beam, 12” deep
and 12” wide and reinforced with 2 ½” reinforcement bars shall be installed
to support the exterior walls. A minimum 4” thick concrete floor slab
reinforced with wire mesh or fiber mesh shall be installed within the
perimeter beam and shall be formed to allow a continuous pour consisting of
the required grade beam and floor.
Section 4.
Electrical Safety Standards. The latest edition of the National
Electrical Code is hereby adopted with the following amendments.
1. Insert “City
of Clinton” and “Iowa” where such insertions are necessary and appropriate.
2.
Amend Article 80 by adding the following
sentence after the title:
“Where a conflict exists between the National
Electrical Code and the International Building Code in the administration
this code, the requirements of Chapter 1 of the International Building Code
shall apply.”
3. Amend Article 80.2 by changing “Chief
Electrical Inspector” to “Electrical Inspector” in the 2nd paragraph and
deleting the 3rd paragraph.
4. Amend Articles 80.15 by adding the
following sentences after the title.
“The Fire/Housing Board of Appeals shall have
responsibility for the requirements of this Article until such time as an
Electrical Board is appointed by the City Council.”
5. Amend Article 80.19(F)(3) by inserting
“3” in the space provided.
6. Amend Article 80.25 (c) by inserting “3”
in the space provided.
7. Delete Article 80.27, Inspector’s
Qualifications.
Section 5.
Mechanical Safety Standards… The latest edition of the Uniform
Mechanical Code is hereby adopted with the following amendments.
1.
Insert “City of Clinton” and “Iowa” where such insertions are necessary and
appropriate.
2.
Amend Chapter 1 by adding the following
sentence after the title:
“Where a conflict exists between the Uniform
Mechanical Code and the International Building Code in the administration
this code, the requirements of Chapter 1 of the International Building Code
shall apply.”
3. Amend Section 110.2 by adding the
following sentences after the title.
“The Fire/Housing Board of Appeals shall have
responsibility for the requirements of this Article until such time as a
Board of Appeals is appointed by the City Council.”
4. Amend Section 301.1 by adding a new
section:
301.1.5.
Lead pipe shall not be used.
Section 6. Plumbing Safety Standards.
The latest edition of the Uniform Plumbing Code is hereby
adopted with the following amendments.
1. Insert “City of Clinton” and
“Iowa” where such insertions are necessary and appropriate.
2.
Amend Chapter 1 by adding the following
sentence after the title:
“Where a conflict exists between the Uniform
Plumbing Code and the International Building Code in the administration this
code, the requirements of Chapter 1 of the International Building Code shall
apply.”
3. Amend Section 602 by adding a new
section:
602.8 Flexible duct, if used, shall not exceed
3 feet in length.
Section 7. Contractor
Registration.
1.
Any individual or business that is hired
for a fee to perform work covered by the requirement of any building
residential, plumbing, mechanical or electrical code adopted by the City of
Clinton must be registered and insured. Forms and insurance requirements
will be provided by the city.
Section 8. Repealer.
All ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed.
Section 9.
Severability Clause. If any section, provision, or part of this
ordinance shall be adjudged invalid or unconstitutional, such adjudication
shall not affect the validity of the ordinance as a whole or any section,
provision or part thereof not adjudged invalid or unconstitutional.
Section 10. Effective Dates.
1. November 1, 2003: Building
Safety Standards (Section 2); Residential Building Safety Standards (Section
3); Electrical Safety Standards (Section 4).
2.
July 1, 2004: Mechanical Safety
Standards (Section 5); Plumbing Safety Standards (Section 6).
