CLINTON COUNTY BOARD OF HEALTH
BYLAWS
I.
MEMBERSHIP
A.
The Clinton
County Board of
Health shall
consist of five
(5) (5) members,
at least one (1) who shall be licensed in Iowa as
a a
doctor of medicine and
surgery or as an osteopathic physician physicand
surgeon, as defined by law.
B.
All members
shall
be
appointed
by
the
Clinton
County
Board
of Supervisors and shall serve for
a period of three (3) (3)
years.
C.
Vacancies shall
be filled
as soon as possible after
the vacancy
exists by appointment
of the Clinton County Board of Super-
visors for the expired term of the original appointment.
II.
OFFICERS
A.
The
Clinton
County
Board
of
Health
shall,
at
its
first meeting
of
each
calendar year, elect one of its members to serve
as
Chairperson
until the
first
meeting of the following year.
1.
The Board shall elect a Vice Chairperson and other officers officers
as it may deem advisable.
2.
In
case of
a
vacancy of the
office of Chairperson, a successosucessor shall be
elected at
the next meeting, who
shall shall
serve the remainder of the term.
3.
In the absence of the Chairperson, the Vice Chairperson Chairpershall assume the duties of the Chairperson.
III.
MEETINGS
A.
The Board shall meet a minimum of
four (4) times annually.
The place, date and
time shall be determined by vote of the Board.
B.
Special meetings
may be
called, as
needed, by
the Chair- person or by
any three (3) members.
C.
Three (3) members shall constitute a quorum.
D.
D. The
Secretary to the Board will be responsible for notifying the press
of meetings
not less than twenty-four (24) hours prior to each meeting.
IV.
POWERS AND DUTIES
A. The rules
and regulations
of this
Board shall
become effective upon
approval by the Clinton County Board of Supervisors and publication in a
newspaper of general circulation in Clinton County.
1.
Before approving any rule or regulation,
this local Board shall
hold a
public hearing
on the
proposed rule
or regulation.
A
notice
of the
public hearing,
stating the time
and place and the
general nature
of the rule or
regulation, shall be
published not
less than
four (4)
nor more
than twenty
(20) days
before the hearing
in a
newspaper of
general
circulation in
the area
served
by the Board.
Reasonable effort
shall be made
to notify
communicative media of the
hearing.
B.
Members of
the Board
shall receive
reimbursement for
reasonable and proper
expenses incurred in the discharge of Board duties.
1.
Mileage
to and
from meetings
is to
be paid at the
rate
approved for
the County
by the Clinton
County Board of Supervisors.
2.
All other
expenses incurred
by a
Board member
will be reimbursed on
the basis
of reasonable and proper costs,
as approved by the
Chairperson.
C.
The Board
may employ such
employees as are necessary for the efficient discharge
of its
duties.
Employment practices
shall meet
the requirements of
the Personnel
Commission or
any Civil
Service provision
adopted under Chapter 400
of the Iowa Code.
D.
The Board
may provide
such personal and
environmental health services as
may be deemed necessary for the protection and improvement of the public health.
1.
May engage
in joint operations
and contract
with colleges
and universities,
the state
department, other
public and
private agencies, and
individuals for
public health
activities or
projects.
E.
The Board shall
enforce state health laws and the
rules and lawful
orders of the state
department.
1.
It
shall also
make and
enforce such
reasonable rules
and
regulations not
inconsistent with law or with the rules of
the
state
board, as
may be
necessary for
the protection
and
improvement of public
health.
F.
The Board may charge reasonable fees for personal health services.
No
person
shall be
denied necessary services within the limits of available personnel because of an
inability to pay the cost of such services.
G.
The Board
may issue licenses and permits and charge reasonable fees therefore
in relation to the collection or disposal of solid waste and the construction
or operation of private water
supplies or sewage disposal facilities.
H.
The Board
shall provide reports of
its operations and activities to the state
department as may be required by the director.
V.
AMENDING BYLAWS
A.
The Bylaws of this Board may be
amended by a two-thirds (2/3) vote of the
Board membership present and voting.
VI.
PARLIMENTARY AUTHORITY
A.
The rules contained in Roberts’ “Rules
of Order, Revised” shall govern the
Board in all cases wherein they do not conflict with these bylaws.
VII.
CONFLICT OF INTEREST
A.
Disclosure
1. Any member
of the Board who will derive any profit or gain, directly
or indirectly, by reason of
membership on the Board
or
for services to the Board or
its Health Department shall
disclose
such interest
to the
Board and
will refrain from
participating in
any decision on such matters.
This person
shall
also disclose any known
significant reason(s) why the
transaction(s)
might not be in the best interests of the Board
or it’s Health
Department. The
person’s abstention from the
vote and
the reason for
it will be recorded in
the minutes of
any meeting at which such
matters are discussed.
B.
Conflict of interest statement
1. Each
Board member shall annually complete an individual statement
regarding conflict of interest.
